These Terms of Service ("Terms") govern your access to and use of the everboarder marketing website and product (together, the "Services") provided by everboarder ("we", "us", or "our"). everboarder provides AI-powered sales practice tools, templates, and related resources. Features, functionality, and availability of the Services may change over time. We may add, modify, or discontinue features at any time.

Accounts and eligibility

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 16 years old and legally able to enter into binding contracts to use the Services. The Services may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or availability of any third-party site or service.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERBOARDER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

Indemnification

You agree to indemnify and hold harmless everboarder and its affiliates from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another party.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, other users, or third parties. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which everboarder is established, without regard to conflict-of-laws principles. Any dispute arising from these Terms will be resolved in the courts of that jurisdiction.

Material changes will be communicated through the Services or by email where appropriate. Continued use of the Services after any update indicates acceptance of the revised Terms.
